The Supreme Court has delivered a major setback to journalist and former Tehelka Editor-in-Chief Tarun Tejpal. The apex court rejected his plea seeking exemption from surrendering. The bench directed the 63-year-old editor to surrender before jail authorities within two weeks. He must begin serving a 10-year rigorous imprisonment sentence awarded in a 2013 sexual assault case.
Rejection of Plea for Exemption from Surrender
Tejpal had approached the apex court, challenging his conviction and seeking protection from arrest. However, the Supreme Court refused to stay the surrender requirement. The judges ruled that he must surrender first and submit a compliance certificate.
Only after completing the formal surrender will the court hear his criminal appeal. The bench has listed his main petition against the conviction for hearing on September 22.
2013 Goa Hotel Incident
The criminal case dates back to November 2013 during an annual event in Goa,. A junior woman colleague accused Tejpal of sexually assaulting her inside the elevator of a luxury resort in Bambolim.
The Goa Police initiated a suo motu criminal probe after leaked internal emails surfaced in the media.
Investigators charged him under stringent Indian Penal Code provisions for rape by a person in authority, sexual harassment, and wrongful confinement.
From Trial Court Acquittal to High Court Conviction
The high-profile legal battle saw dramatic shifts across judicial forums over the past decade. In May 2021, a Goa Sessions Court acquitted Tejpal of all criminal charges.
The Goa government quickly challenged the acquittal before the Bombay High Court.
On August 6, the High Court set aside the lower court order and found Tejpal guilty of rape. The court sentenced him to 10 years of rigorous imprisonment and imposed monetary fines payable to the survivor.
Supreme Court Appeal and the Road to September Hearing
Tejpal maintains that the charges against him stem from political vendetta. Meanwhile, the Goa state government has also approached the Supreme Court seeking an enhanced sentence of life imprisonment.
With the apex court rejecting his exemption plea, Tejpal must report to jail authorities before the two-week deadline expires. The Supreme Court will examine the merits of both appeals during the upcoming September hearing.
